Happy Birthday

This song was written by two sisters from Kentucky: Mildred Hill and Patty Hill. They both taught nursery school and/or kindergarten. Patty invented the "Patty Hill blocks" used in schools nationwide, and served on the faculty of the Columbia University Teachers College for thirty years. Mildred, who was the older sister, studied music and became an expert on Negro spirituals. In 1893, while Mildred was teaching at the Louisville Experimental Kindergarten School where her sister served as principal, she came up with the melody to this song. Patty added some lyrics and it became a song called "Good Morning to All," which was a way for teachers to greet students.

Later in 1893, the song was published in the songbook Song Stories For The Kindergarten, and other schools started singing it. After a while, it became more popular for kids to sing it to teachers, and the song became commonly known as "Good Morning To You," since the third line could be changed to fit the subject.

It's unclear who wrote the words "Happy Birthday To You," but the lyrics first appeared in a songbook in 1922 as the optional third verse of "Good Morning to You" (listed as "Good Morning and Birthday Song") with the lyrics to "Happy Birthday" as the optional third verse, and instructions on how to insert the birthday child's name.

Various movies and radio shows started using the song as a birthday greeting, and "Good Morning To You" morphed into "Happy Birthday To You." It was used in the 1931 Broadway musical The Band Wagon and was part of Western Union's first "singing telegram" in 1933. It was also used in the Irving Berlin musical As Thousands Cheer. The Hill sisters were not compensated for use of "Happy Birthday To You," so their other sister Jessica filed suit to prove that "Happy Birthday To You" was their song with different lyrics. The court agreed and gave the Hill sisters the copyright to "Happy Birthday To You" in 1934, which meant that anytime it was used in a movie, radio program, or other performance, the Mildred and Patty Hill were compensated. (In the case of Mildred, her estate was compensated, since she died in 1916.)

The Clayton F. Summy Company, working with Jessica Hill, published and copyrighted "Happy Birthday" in 1935. Under the laws in effect at the time, the Hills' copyright would have expired after one 28-year term and a renewal of similar length, falling into public domain by 1991. However, the Copyright Act of 1976 extended the term of copyright protection to 75 years from date of publication, and the Copyright Term Extension Act of 1998 added another 20 years, bringing copyright protection to "Happy Birthday" until at least 2030. Challenges to the copyright itself (see below) nullified this copyright in 2015.

Warner Chappell, the largest music publishing company in the world, got the rights to this song when they bought what was The Clayton F. Summy Company in 1998 for a reported price of $25 million. They spun off the company as Summy-Birchard Music, which became a part of Time Warner.

The song brought in about $2 million in royalties every year, with the proceeds split between Summy-Birchard and the Hill Foundation. Both Hill sisters died unmarried and childless, so their share of the royalties presumably went to charity or to nephew Archibald Hill ever since Patty Hill passed away in 1946.

When this song was under copyright (1949-2015), you could sing it at a birthday party without paying royalties, but anytime it was performed in public in front of a large gathering of people (like at a concert) or broadcast, a performance license was required. This is normally issued in the US by three companies: ASCAP, BMI and SESAC - The Hill Foundation is a member of ASCAP.

Companies that are required by law to have performance licenses operate radio stations, TV stations, concert venues, and restaurants and other retail outlets over a certain size where music is played. A blanket deal with ASCAP means these venues could sing "Happy Birthday" as much as they'd like, but many outlets didn't have such a deal, which is where it got tricky.

Some TV networks, for instance, clear songs on an individual basis, so if a host decided to serenade an audience member with "Happy Birthday," the station was on the hook, and ASCAP would send them a bill for pretty much any amount they deemed reasonable. Broadcasters in these situations were under strict orders NOT to sing it. Many restaurants created their own birthday songs in large part to avoid legal trouble.

On September 22, 2015, a judge ruled that the copyright to "Happy Birthday to You" was invalid, putting the song in the public domain.

The lawsuit was filed in 2013 by Jennifer Nelson, a filmmaker working on a documentary about the song. After researching the song, she decided that it should be free to the public, and she objected to the $1,500 payment Warner Music asked for its use in her film, prompting the legal action.

As evidence in the case, Nelson presented the 1922 songbook where the song's lyrics first appeared. Since the Copyright Term Extension Act of 1998 states that any work created before 1923 is public domain (keeping Mickey Mouse and other Disney copyrights valid), "Happy Birthday" would thus be free.

The case had an impact not just on those hoping to use the song gratis, but on those who had already paid royalties for its use, since those could possibly be recouped. In December 2105, a settlement was reached with Warner Music agreeing to pay $14 million to thousands of people and entities in a class action who had paid to license the song. Months later, the same law firm was employed in effort to bring the song "We Shall Overcome" into the public domain.

It was rumored that Paul McCartney owned the rights to this song. McCartney bought the publishing rights to a lot of songs (including most of Buddy Holly's), but he does not own this one.

One of the most famous performances of this song was Marilyn Monroe's rendition to US President John F. Kennedy in May 1962 at Madison Square Garden. Monroe was accompanied on the piano by jazz pianist Hank Jones who recalled in a 2005 interview on National Public Radio: "She did 16 bars: eight bars of 'Happy Birthday to You' and eight bars of 'Thanks for the Memories. So in 16 bars, we rehearsed eight hours. She was very nervous and upset. She wasn't used to that kind of thing. And, I guess, who wouldn't be nervous singing 'Happy Birthday' to the president?"

In our interview with Tom Gabel of Against Me!, he told us: "If I could have written any song in the world it would have been 'Happy Birthday.' It's the only song that groups of people annually sing specifically for someone specifically in an attempt to make them feel special. It's a completely unique song and it's ubiquitous." (Gabel would later identify as female and take the name Laura Jane Grace.)

This was named the highest-earning song of all time in the documentary The Richest Songs In The World, which aired on BBC Four on December 28, 2012. Runner-up was Irving Berlin's "White Christmas."

This was the first song to be performed in outer space. On March 8, 1969, the astronauts on Apollo IX sang it to celebrate the birthday of Christopher Kraft, who at that time was director of NASA space operations.

In a 1989 Time Magazine article, this was one of the three most popular songs in the English language, along with "Auld Lang Syne" and "For He's A Jolly Good Fellow." (thanks, Jimmy - Bronxville, NY)

This 15 minute mammoth is a reworking of the original, "Killers are Quiet," that can be found on the band's debut Mate, Feed, Kill, Repeat. The song is about someone who kills women and recreates them in his own image, like a living doll type thing. (thanks, Tim - Pittsburgh, PA)

Ease My Mind

This is based around a sample of Swedish electronic duo Niki & The Dove's 2012 ballad "DJ Ease My Mind." Skrillex told NME: "It's so anthemic; I love how emotional Niki is. There's so much dramatic passion coming from the dance scene at the moment."

Asked by NME how she and Skrillex first met, Nikki & The Dove's Malin Dahlstrom recalled: "A friend of ours played 'DJ, Ease My Mind' for Sonny and then he contacted us saying that he wanted to do a version, which ended up on his album."

"We didn't meet until recently, in LA. a pleasant meeting," she added. "Sonny is the warmest person! We used to say that 'DJ, Ease My Mind' is a song that has nine lives. It's had several different versions before the one on our album."

One Slip

This is about falling in love and what is love, how one event can change your whole life. How one slip is all it takes. It is not ultimately about sex or love, but about unintended consequences. In the song, a man spots a woman across the room. Their eyes meet, and soon they are both giving in to sexual impulses. A pregnancy results, as is subtly implied with the words "soon the seeds were sewn" and "the year grew late," as well as by the sound effects at the beginning of the song which are a metaphor for sperm trying and then contacting the ovum.

The album title came from a line in this song: "A momentary lapse of reason." The "momentary lapse of reason" is a reckless sexual indulgence, without protection, which "binds a life to a life" via the unplanned child. We know that "neither one wanted to remain alone" as the pregnancy progressed, which implies that if the pregnancy was unplanned, at least the man involved was ready to take responsibility.

This was used as the B-side of "Learning To Fly." (thanks, Mike - Mountlake Terrace, Washington, for all above)

Dave Gilmour wrote this song with Phil Manzanera of Roxy Music. Working with different collaborators seemed to bring out different sides of Gilmour's personality, which was reflected in the lyrics.

Former Felice Brothers drummer, Simon Felice, recorded his second solo album up in the Catskills Mountains at his friend David Baron's studio. He recalled to Uncut magazine. "Making Strangers was unique among the records I've worked on in that it was all done in one place: a good friend's studio at the top of a dead-end mountain road."

Felice added to American Songwriter magazine: "I'd walk through the woods to the old house Jimi Hendrix occupied when he lived here in the late 60s, work out lyrics and melodies on those walks, commune with the ghosts."

This album closer was inspired by a woman who said she would hypnotize Felice for five dollars. He gave her the money and when he opened his eyes she'd gone. Later Felice asked who she was at the local gas station, and he was informed that she was a Acid casualty and he'd been robbed. Felice went straight to the studio and recorded this song, which he told American Songwriter, "was written in something close to a state of grace, which rarely happens for me."

Lake Of Fire

The "Lake Of Fire" is Hell. There is a lot of biblical imagery in the lyrics, and the song can be seen about how the Christian church uses the idea of hell to scare people into following their beliefs (Meat Puppets did a version of a song called "Jesus Don't Want Me For A Sunbeam" which is also very sarcastic).

The song's writer, lead singer Curt Kirkwood, didn't set out to write religious commentary - his inspiration was far more jocose. He told us: "A lot of times I don't remember writing songs, I can't remember anything about like, how did I come up with that? But 'Lake of Fire,' we were all living together and everybody decided to go to a Halloween party, and they were all getting in costumes. And I thought, 'Man, this is one of the stupidest things - adults getting dressed up like we did when we were little kids.'

I had actually got pretty wasted on something and told everybody, 'No, I'm not going.' And then once I was alone, I just started messing around. I wrote a couple of songs that night. I wrote 'Magic Toy Missing' and 'Lake of Fire,' maybe one more. But I was just really trying to make fun of my friends for going out to a Halloween party." Nirvana performed this song on their 1993 MTV Unplugged appearance, which was also released as an album called MTV Unplugged in New York the next year. Along with "Lake Of Fire," Nirvana also played two other Meat Puppets songs: "Plateau" and "Oh, Me." They were joined by Curt and Cris Kirkwood of Meat Puppets for these three songs.

Kurt Cobain was a huge Meat Puppets fan and would often mention them as an inspiration. "He was always in the moment," Curt Kirkwood told us about Cobain. "He wasn't very conversive, just really, really casual. I was pretty blown away by the whole thing, just on the level of how it was and wasn't, like my concept of it. It was a strange thing to be around, because there was so much attention at any point coming from every direction."

The first track lifted from A Better Tomorrow features guest R&B singer-songwriter Nathaniel on the hook who makes it clear the Wu is back. Longtime collaborator DJ Mathematics supplies the marching beat. Wu-Tang described the cut as "Classic 90s Mono Beat, infused with lyrical dart throwing content."

Method Man shouts out Kanye and Frankenstein's right-hand man, Igor, in the first verse, while also referencing Star Trek's Leonard Nimoy. Second in line is Inspectah Deck, who weaves some bi-lingual wordplays. Third up up is Cappadonna who offers up some gritty bars and GZA wrap things up with some astronomical-related couplets. Raekwon doesn't appear on the cut and tweeted "Keep dreaming" after the track appeared online, maybe as a nod to the title.

Kiss guitarist Ace Frehley wrote this song, which is about a guy who has only his gin to keep him warm. Frehley explained: "I wrote 'Cold Gin' in a New York subway, in my head, both lyrics and music. Gene Simmons: "Ace [Frehley] brought in 'Cold Gin.' When we first heard it I remember being struck by that great opening guitar riff, which was the basis of the song. The problem we had with it was that after the verse and chorus, it didn't seem to go anywhere. It was an unfinished idea. I suggested a section in the middle of the song that became the riff part of the song. It changed the song from an 'A' voicing to a riff section in the key of 'G' and kept ascending up the scale until it finally wound up in an 'E.' Paul suggested a couple of arrangement modifications in the song, and presto, 'Cold Gin,' the complete song. I insisted that Ace should sing the song, but he refused and said that he preferred I sing it. The original version of the song as recorded on the first Kiss demo, changed very slightly through the years and was to remain a staple of our live concerts to this day." This was written during the war in Vietnam. It is protesting to stop the war and return home the young men who were sent to fight.

Although this received a lot of airplay in the States, it was banned by the US Command from the American Forces Network for fear that it would "give aid and comfort to the enemy."

This was not included in the first 50,000 copies of Contact. It was added onto the album when it became a hit.

I Pretend

This song is a heartbreaker, with Carnes singing about how she lost her man, and now all she can do to comfort herself is to pretend they are still together. The song was written by Brian Fairweather and Martin Page, who had a group called Q-Feel. In our interview with Page , he explained that the song did not come from personal experience, since at the time he didn't put himself in his lyrics (this changed with his first solo single "In the House of Stone and Light").

"'I Pretend' was a ripoff of me listening to the Pointer Sisters," he explained. "In fact, I took it to Planet Records where the Pointer Sisters were. There was an interest in it, but it didn't sell any seats."

Page and Fairweather got the attention of Kim Carnes' label boss Gary Gersh with their song "Dancing In Heaven (Orbital Be-Bop)," which got a lot of airplay on the Los Angeles radio station KROQ. When he heard their demo of "I Pretend," he played it over the phone for Carnes, who loved it. Gersh arranged for the trio to work together, which resulted in three songs from her Café Racers album: "You Make My Heart Beat Faster (And That's All That Matters)," "I Pretend," and "Invisible Hands." All three made the Hot 100. A few years later, Page offered Carnes another song he wrote: "These Dreams." She passed, and that one became a #1 hit for Heart.
